Terms of Service
1. These Terms and the Parties
1.1 These terms of service ("Terms") govern the supply of passport application management services made available through the website at asappassports.co.uk (the "Website") under the trading name "ASAP Passports".
1.2 Your contract is with Global Passport Logistics LLC of 1111B S Governors Ave, Suite 6666, Dover, DE 19904, United States, a limited liability company incorporated in the State of Delaware and supervised and regulated by the Secretary of State, Delaware ("GPL US", "we", "us", "our").
1.3 The Services are performed on behalf of GPL US by Global Passport Logistics Limited of 15 Hanover Square, 6th Floor, Lion Suite, London W1S 1HS, England, a company incorporated in England and Wales with company number 15192735 ("GPL UK").
1.4 By placing an order through the Website or by any payment link we provide to you, you agree to be bound by these Terms.
2. Nature of the Services; Independence
2.1 We provide a managed application-assistance service for United Kingdom passports (the "Services"), comprising, as applicable to the service level purchased: review and checking of your documents and photographs; preparation and lodgement of your application with His Majesty's Passport Office ("HMPO"); management of the application through HMPO's processes; physical collection of your new passport from HMPO where the service level includes it; and courier delivery of your new passport to your nominated address by DHL Express.
2.2 We are an independent commercial organisation and a registered UK passport agent. We are not GOV.UK, HMPO, or any part of the government of the United Kingdom, and we are not affiliated with, endorsed by, or acting on behalf of any government body. You can apply for a UK passport yourself directly with HMPO without using our Services and without paying our fees; HMPO's own fees are lower than our all-inclusive prices, which include our service fee and the disbursements described in clause 4.
2.3 The issue, refusal, withholding or cancellation of any passport is at all times a decision of HMPO alone. We do not and cannot guarantee that a passport will be issued.
3. Eligibility and Service Levels
3.1 The Services are offered at the service levels, prices and published timeframes set out on the Website at the time of your order (each a "Service Level"). Service Levels are divided into:
(a) "Guaranteed Services" — Service Levels expressly stated on the Website to carry a guaranteed timeframe (at the date of these Terms: VIP adult renewals, and eligible renewals, replacements, child renewals and name or details changes at the Gold service level); and
(b) "Best-Endeavours Services" — Service Levels expressly stated on the Website to carry an estimated timeframe only (at the date of these Terms: first adult and first child applications, and applications relating to passports issued before 1994). Best-Endeavours Services are not guaranteed, and published timeframes for them are genuine estimates only.
3.2 Eligibility for each Service Level depends on your circumstances, including the date of issue of your most recent UK passport, as set out on the Website. We confirm your eligibility, and the correct Service Level for your circumstances, before or promptly upon your order. If the information you provide shows that a different Service Level applies, we will notify you and clause 6 (credit) applies to any difference.
4. Prices and Payment
4.1 The price for each Service Level is the all-inclusive price published on the Website, which includes our service fee, HMPO's application fees, courier collection of your documents, secure carriage, and courier delivery of your new passport to your nominated address ("Fees"). A card payment processing fee is itemised separately at checkout and is collected on behalf of the payment processor; it does not form part of our Fees.
4.2 Payment is due in full at the time of order and is processed by Stripe. We do not store your card details.
4.3 You expressly request that we begin performing the Services immediately upon payment, including confirming your eligibility and preparing your application, and you acknowledge that, once the Services have commenced being performed, you lose any right you may otherwise have had to cancel. For this reason, please consider carefully before paying, as we do not accept cancellations for any reason.
5. The ASAP Guarantee
5.1 This clause 5 applies to Guaranteed Services only. It does not apply to Best-Endeavours Services.
5.2 The "Guarantee Period" for each Guaranteed Service is the period published on the Website for that Service Level at the time of your order (at the date of these Terms: two (2) weeks for VIP adult renewals; three (3) weeks for Gold-level renewals, replacements, child renewals and name or details changes).
5.3 The Guarantee Period begins on the day DHL Express collects your complete and correct document pack (including, where applicable, your existing passport) from you, and not on the date of payment.
5.4 The Guarantee Period ends, and the guarantee is satisfied, upon the first attempted delivery of your new passport by DHL Express to your nominated address.
5.5 If the first attempted delivery of your new passport does not occur within the Guarantee Period (as extended under clause 5.6, if applicable), we will refund you the full amount of the Fees you paid for the affected Service (excluding the separately itemised card payment processing fee) to your original payment method within fourteen (14) days (the "Guarantee Refund").
5.6 The Guarantee Period is paused, and extended by the corresponding number of days, only where and for so long as:
(a) HMPO raises requirements, queries or requests arising from information or documents you supplied that were inaccurate, incomplete or misleading;
(b) you delay in responding to a request from us or from HMPO for information, documents or action reasonably required to progress your application; or
(c) an event beyond our reasonable control (including, without limitation, industrial action affecting HMPO or DHL, governmental action, epidemic, or failure of public infrastructure) prevents or delays performance.
We will notify you by email on the day any pause under this clause begins and the day it ends. No other circumstance pauses or extends the Guarantee Period.
5.7 The Guarantee Refund is your sole and exclusive remedy, and our sole liability to you, for any failure to meet a published guaranteed timeframe.
6. No Cancellation; No Refunds; Service Credit
6.1 Except for the Guarantee Refund under clause 5, no refunds are given in any circumstances after payment, including without limitation change of mind, change of travel plans, choosing to apply directly with HMPO, or a decision of HMPO to refuse or withhold a passport.
6.2 Orders may not be cancelled after payment (and see clause 4.3).
6.3 However, where you do not proceed with a purchased Service for any reason other than a missed guarantee, the full amount you paid will be held as service credit for a period of three (3) months from the date of payment. Service credit may be applied to any Service we offer, by you or by a person you nominate, and is not redeemable for cash. Service credit not used within three (3) months expires.
6.4 Where a passport is refused or withheld by HMPO as a result of information or documents you supplied that were false, inaccurate or misleading, no refund or service credit is given.
7. Your Obligations
7.1 You must: (a) provide information and documents that are true, accurate, complete and not misleading; (b) respond promptly to requests from us or HMPO; (c) ensure your document pack is complete and available for the arranged DHL collection; (d) ensure someone is available to receive delivery at your nominated address, or make arrangements with DHL; and (e) comply with all applicable laws in connection with your application.
7.2 You warrant that you are entitled to apply for the passport applied for, and, where you order on behalf of another person (including a child for whom you hold parental responsibility), that you are authorised to do so and to provide their personal data to us.
8. Liability
8.1 Nothing in these Terms excludes or limits any liability that cannot be excluded or limited by applicable law, including for death or personal injury caused by negligence, or for fraud.
8.2 Subject to clause 8.1, our total aggregate liability to you arising out of or in connection with the Services, whether in contract, tort (including negligence), breach of statutory duty or otherwise, shall not exceed the Fees you paid for the affected Service.
8.3 Subject to clause 8.1, we shall not be liable for: (a) loss of or failure to obtain travel, accommodation, visas, events or any other arrangements, or their cost; (b) loss of income, profit, business or opportunity; or (c) any indirect or consequential loss — in each case even if we were aware of the possibility of such loss. You are responsible for your own travel arrangements, and we strongly recommend that you do not book travel that depends on receiving a passport by a particular date.
8.4 Decisions of HMPO, and the accuracy of HMPO's published processing information, are outside our control, and we are not liable for them.
9. Complaints
9.1 Complaints may be sent to hello@asappassports.co.uk and will be acknowledged within two (2) business days.
10. General
10.1 These Terms, together with the service description and prices published on the Website at the time of your order, constitute the entire agreement between you and us relating to the Services.
10.2 We may vary these Terms from time to time; the version in force at the time of your order applies to that order.
10.3 If any provision of these Terms is found to be invalid or unenforceable, the remainder continues in force.
10.4 You may not assign your rights under these Terms without our written consent. We may assign or subcontract our rights and obligations, including performance by GPL UK under clause 1.3.
10.5 These Terms, and any dispute or claim arising out of or in connection with them or the Services, are governed by the law of the United States of America, and the courts of the State of Delaware shall have non-exclusive jurisdiction in connection with any such dispute or claim, provided that nothing in this clause deprives any consumer of the protection of mandatory provisions of the law of their country of habitual residence.
Privacy Policy
1. Who We Are
1.1 This policy describes how personal data is handled in connection with the Services. Global Passport Logistics LLC (Delaware, USA) and Global Passport Logistics Limited (England and Wales, company number 15192735) act as joint controllers of your personal data. 2. The Data We Collect
2.1 To perform the Services we collect: identity data (name, date and place of birth, nationality); passport data (passport numbers, issue and expiry dates, and your physical passport where the Service requires it); passport photographs; contact data (email, telephone, delivery and billing addresses); travel information you volunteer (such as planned travel dates); application details required by HMPO; and correspondence with us.
2.2 Where you order on behalf of a child, we collect the child's identity, passport and photographic data from you as the responsible adult.
2.3 Payment card data is collected and processed by Stripe; we do not receive or store your full card details.
2.4 Our Website and application portal collect technical data (device, browser, pages viewed, approximate location) through the analytics services described in section 7.
3. Why We Use Your Data
3.1 We use your data: (a) to perform the contract — confirming eligibility, preparing and lodging your application with HMPO, arranging courier collection and delivery, and communicating with you about your application; (b) to comply with legal obligations to which we are subject; (c) for our legitimate interests in operating, securing and improving the Services, keeping business records, and enforcing our terms; and (d) with your consent, where we ask for it, for marketing communications.
4. Who Receives Your Data
4.1 Your data is shared, to the extent necessary for the Services, with: HM Passport Office (your application and supporting documents); DHL Express (names, addresses and contact details for collection and delivery); Stripe (payment processing); our application-portal and hosting providers; our email service provider; and our professional advisers where reasonably required.
4.2 We do not sell personal data.
5. International Transfers
5.1 Your data is processed in the United Kingdom (where the Services are performed), in the United States (where GPL US is established and certain service providers operate), and in other regions where our infrastructure providers host services (including email infrastructure hosted in Japan). Where data is transferred outside the United Kingdom, we take steps designed to ensure it receives an adequate standard of protection, including the use of providers' standard contractual safeguards.
6. Retention
6.1 Application records, including identity and passport data, are retained for two (2) years after your matter completes, and thereafter only as required for legal and regulatory purposes.
6.2 You may request deletion at any time under section 8; requests are honoured except where retention is required for the purposes permitted by law.
8. Your Rights
8.1 Subject to applicable law, you have the right to request: access to your personal data; correction of inaccurate data; deletion; restriction of processing; portability; and to object to processing based on legitimate interests. Where processing is based on consent, you may withdraw consent at any time. Requests: hello@asappassports.co.uk. You also have the right to complain to a supervisory authority, including the UK Information Commissioner's Office.
9. Changes to This Policy
9.1 We may update this policy from time to time. The current version will always be published on the Website, with its effective date.
